Indeed, the trend towards single-IRB review for research, in which several institutions participate, has been spurred by developments such as the NIH Single IRB Policy Agreement, letter or similar document, which sets out the intention of two or more parties to cooperate or pursue future activity. A Memorandum of Understanding may contain a description of the proposed cooperation or activity, but does not oblige the Parties to implement or deliver the Project, unless this is stipulated in a subsequent legally binding agreement. A Memorandum of Understanding may expressly state that it is not binding or, in another way, draw attention to the absence of a legal obligation for the parties. It contains conditions representative of a cooperation agreement on fundamental research which contains provisions on the transfer of material, but any such agreement shall be subject to amendments based on the unique aspects of any cooperation.
